An application for a certificate of inheritance is a formal application made to the probate court to obtain a certificate of inheritance. The certificate of inheritance is an official document that confirms the succession and proves a person’s eligibility as an heir to legally manage the deceased’s assets. The applicant must provide relevant documents to prove his/her entitlement to inherit.
A declaration of inheritance is the formal rejection of the inheritance by a potential heir. It must be received by the competent probate court within six weeks of knowledge of the accrual of the inheritance and the reason for the appeal (statutory or intestate succession). If someone disclaims his right of inheritance, he renounces becoming the legal successor of the deceased. This happens for various reasons, such as to avoid debts or liability for the decedent’s debts, or because of personal reservations about the decedent.
